The ownership of a trademark in Brazil and its exclusive use within the Brazilian territory is guaranteed only by its registration.

Registration is valid for 10 years and may be renewed for 10 year periods thereafter by its owner.

Trademarks may be registered in nominative, figurative, mixed or three-dimensional form.

The entrepreneur who invests in technology must register a trademark, a patent or an invention to guarantee financial return on his investment and avoid the possibility of his creations being copied and exploited by competing companies.

In the lack of registration there is a serious risk that a competitor will register the trademark or invention, becoming the owner of an asset to which they have not contributed, and may even prevent the true creator of the trademark or invention from using it.

Commits crime against a patent or utility model whoever manufactures a product protected by a patent or utility model without the authorization of the holder; or use a medium or process that is the subject of a patent without the authorization of the holder.

The holder of the patent is assured the right to obtain compensation for improper exploitation of its object, including the exploitation occurring between the date of publication of the application and the grant of the patent.

Intellectual property is guaranteed to inventors or those responsible for any creation of intangible goods in the industrial, scientific, literary or artistic fields.

Every author is the owner of his work. The use of any text, video or music and its publication or distribution as if it were someone else's without the permission of the real creator is prohibited.

If you have developed a computer program you must apply for registration with the INPI. Registration ensures greater legal certainty for its holder in case of a court demand to prove the authorship or ownership of the program.

Computer program registration is valid for 50 years from its creation or January 1 of the year following its publication. Protection is not territorial. Coverage is international, comprising the 175 signatory countries of the Berne Convention (1886).
